  3. TERMS AND CONDITIONS OF SALE

  5. RETURN POLICY Goods may be returned at the time of delivery for a full credit. Unopened, unused, and undamaged boxes may also be returned within 90 days of the invoice date; a restocking fee equal to 7% of the product value may apply. Returns are not accepted for goods delivered more than 90 days ago, nor for any Dairy or Meat products under any circumstances. Approved refunds will be issued as a credit note within 10 days.

  7. PAYMENT & DELIVERY Goods remain the property of Hatti Foods Inc. until full payment has been received. A CAD $50 fee applies to any bounced cheque. A separate delivery charge applies to orders below CAD $500.


  8. GENERAL TERMS


    1. The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
    2. In the event of non-payment by the due date indicated on the invoice or order, Hatti Foods Inc. reserves the right to request a fixed interest payment amounting to 10% of the sum remaining due. Hatti Foods Inc. will be authorized to suspend any provision of services without prior warning in the event of late payment.
    3. If a payment is still outstanding more than sixty (60) days after the due payment date, Hatti Foods Inc. reserves the right to call on the services of a debt recovery company. All legal expenses will be payable by the client.
    4. All our contractual relations will be governed exclusively by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
